MINUTES OF THE PUBLIC MEETING OF JANUARY 11TH, 2005
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  8:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman in Meeting Room A in the Town Hall.

Appointments  (7:30 PM)

Jim Brown of Bonney Hill Lane, asked the Board about signing off on an easement for maintenance of a detention basin on his property.  He was advised to hold off until the Commission receives a copy of the Operation and Maintenance Plan from Bud Doolittle at which time a copy will be forwarded to Mr. Brown for his review.  A second letter shall be drafted to Mr. Doolittle about the status of the O & M Plan and long-term maintenance of the basin and other issues.  

Joe Walsh, owner of Deer Hill I asked the Commission about building a house on Lot 5 as it is 90% developed.  He has a purchaser for the property.   A rare species of turtle was sighted on this lot which has led to Natural Heritage requesting a wildlife habitat assessment that has put the project of Deer Hill Road Extension on hold.  Mr. Walsh was told to contact the Natural Heritage of Endangered Species and ask their opinion on how to proceed.

Public Hearings  (Actually started at 8:30 PM and continued consecutively per agenda)
7:45 PM  Request for Determination of Applicability for the excavation, grading and filling within 100 feet of a bordering vegetated wetland at 109 South Street, Assessor’s Map 24, Lot 37 for Phillip Cantwell represented by Alan Dias, P.O. Box 314, Monponsett, MA  (New Hearing)

Craig Nicholson read the Public Hearing Notice and the abutters were verified.   Alan Dias made the proposal for a septic repair/upgrade and presented a revised plan showing the location of the haybales.   There is minor grading in the 50-foot buffer zone.  Mr. Lindquist read the abutter’s list.  Those present were:   Sharon Jasperson, 115 South Street – All set with plan.

Ms. Delaney suggested approval with the condition that disposal of landscape debris in the wetland be prohibited in the future.

8:00 PM Continued Notice of Intent “Brookside Estates Phase II” for construction of 615 linear feet of new roadway and infrastructure, including two detention ponds at a) 1443 Main St., Map 44/Lot 10 and b) Elm Street, Map 36/Lot 8-2 for applicant Donald Shute, Chilmark Co., 345 Washington St., Pembroke MA represented by GCG Assoc., Inc., 226 Lowell St., Wilmington, MA  01887  (DEP #175-0441)  

Jeremy Downs of GCG Associates made the presentation to briefly address Ms. Delaney’s previous comments in regards to the filing.  They have used the correct NOI form and made changes to the plan.  The wetland line was reviewed by P.M.P. Associates and two changes had been made in the flagging that didn’t affect the buffer zone line.  Another wetland area was shown on the plan although it did not warrant flagging.  The O & M plan had been revised.

Ms. Delaney felt that this should be a Category 3 filing because quite a bit of the grading around the detention pond is in the buffer zone.  There is an additional fee for this.  Donald Shute, applicant said he would pay it.  Also the maintenance of the Detention Basin has to be discussed with the Highway Department to see if they are in agreement with the plan.  Ms. Delaney will contact Dick Harris, Highway Supervisor.

8:45 PM   Continued Request to Amend an Order of Conditions to reduce the scope of work shown on the approved plans at Silverleaf Landscape Design, 800 Franklin St., Assessor’s Map 67, Lot 6A-1 for Merrill Associates, Inc., 427 Columbia Rd., Hanover for potential purchaser of the property, Dale Southworth.  (DEP #175-289)  

Greg Galvin, an attorney for Dale Southworth presented a copy of the recorded Extension Permit with the correct file number as per request of the Commission at the meeting of December 14th, 2004.   Doug Heel from Merrill Associates informed the Board that the re-flagging of the wetland had been done.   Also the Zoning Board of Appeals and Board of Health had issued approval for the changes in the plan which include the paving of the parking lot and the enlargement of the septic system to accommodate 25 employees in the building.  Mr. Lindquist pointed out that grades were not shown on the plan that would account for the direction of drainage from the parking lot.

9:00 PM  Continued Notice of Intent for the construction of a new, single-family house, subsurface sewage disposal system, utilities and site grading at 684 Pleasant Street (LOT 2), Assessor’s Map 8, Lot 4, for Victor Lewis, 231 Brook St., Plympton represented by Land Planning Inc., 1115 Main St., Hanson, MA.  (DEP #175-0455)   

Bob Crowell from Land Planning presented a letter for a Request for Variance for a waiver from the 50-foot no-build zone.  They had contacted the neighbor to inquire about possibly purchasing a piece of property to get the driveway out of the buffer zone.  The neighbor wanted no part of it.  Ms. Delaney recommended that the lot does not conform to the 50-foot setback from the wetlands and disapproves of sub-dividing the lot.

9:15 PM  Request for Determination of Applicability for the construction of an addition to an existing house within 100 feet of a bordering vegetated wetland at 344 Reed Street, Assessor’s Map 24, Lot 79 for Judith McDonald, P.O. Box 268, Hanson, MA  (New Hearing)

Craig Nicholson read the public hearing notice and the abutters were verified.  Ms. McDonald presented a plan for an addition.  Haybales will be installed along the limit of work.  The addition is 83-feet from the wetland line.

Criteria used for filing an NOI -  It was discussed and decided that all construction within 100-feet of a Bordering Vegetated Wetland will require an Notice of Intent filing with the exception of the repair of a septic system.  A septic repair that is out of the 50-foot buffer zone will only require a Request for Determination of Applicability.
